Terms of use

These terms govern your use of the ImportaMT service. ImportaMT is operated by the Malta Competition and Consumer Affairs Authority (MCCAA).

  1. What the service does

    ImportaMT checks, before shipment, whether the compliance documentation you supply for one product is complete and in order, and issues a formal decision recording that assessment.

  2. What the service does not do

    A decision is a verification of documentation only. It is not a product certification, it is not an exemption from market surveillance, and it is not a guarantee of customs clearance.

    The service does not provide:

    • physical inspection of products
    • sampling or laboratory testing
    • product certification
    • type approval
    • legal representation
    • review of commercial contracts
    • customs clearance or tariff classification
  3. Your responsibilities

    You are responsible for the accuracy and completeness of everything you submit, including the declared intended use of the product. Identifying the legislation applicable to a product, and declaring conformity with it, remains the responsibility of the manufacturer and the importer.

  4. Identity and access

    The service verifies documents, not applicants. Access is by control of an email mailbox: a one-time code grants a session, and a signed link grants access to a single request. Anyone who can read that mailbox can see the applications made from it. Keep the links private.

  5. Decisions and validity

    A published decision is immutable. Where a validity date applies, it is stated on the decision together with the reason for it. A validity date is never extended; a later position is recorded by a new decision superseding the earlier one.

  6. Revocation

    Where information about a product later comes to light which could not be determined from the documentation supplied — including safety information, a document found to be false, or a materially inaccurate declared use — the MCCAA may invalidate the verification. The decision page remains resolvable and shows that status prominently.

  7. Fees and refunds

    Where a fee applies it is set by instrument, stated before payment, and payable per request. A refund is at the Authority's discretion; revocation does not itself create a right to a refund, because the review was properly conducted on the information supplied.

  8. Correction, appeal and complaint

    Factual errors in a decision can be corrected on request. An appeal against an outcome is made to the appeals panel; the portal does not administer appeals. Complaints about how the service was delivered go to the MCCAA.

  9. Availability

    The service is provided as-is and without guarantee of uninterrupted availability. Where the verification service cannot resolve a code, that is not a confirmation in either direction.

  10. Governing law

    These terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction.
